Website Terms of Use
The terms that apply to visitors of this website
On this page
1. What this document is, and what it is not
These Website Terms of Use ("these website terms") apply to your use of RTEO's public website at https://rteo.com.au and https://www.rteo.com.au ("this website"), published by ROCKHAWK PTY LTD (ABN 17 673 537 123) trading as RTEO ("we", "us").
These website terms are for visitors: people browsing the site, reading a page, or sending us an enquiry.
If you are an RTEO customer, these are not the terms that govern your use of the platform. A customer's use of the RTEO platform, and the workspaces in it, is governed by the RTEO Terms of Service, together with the Data Processing Agreement and the Acceptable Use Policy. Where those documents and these website terms address the same subject, those documents prevail for anything to do with the platform. Nothing here adds to, limits or varies them.
By using this website you accept these website terms. If you do not accept them, do not use the website.
2. What you may do with this website
You may view this website, and print or download a copy of a page, for your own information or for your organisation's own internal use.
You must not:
- copy, republish, adapt or distribute any part of this website for commercial purposes without our prior written consent;
- present our content as your own, or remove or obscure a trade mark, credit or copyright notice;
- scrape, harvest or bulk-extract content from this website, or use an automated tool to do so, except that a search engine may crawl it in accordance with our robots file;
- use this website's content to train an AI model without our prior written consent;
- attempt to gain unauthorised access to this website or to any system behind it, or probe or test its security; or
- interfere with this website's operation, including by placing an unreasonable load on it.
3. Intellectual property in this website
RTEO, or its licensors, owns the content of this website and all intellectual property in it, including the text, images, video, illustrations, page designs, layout, code and the RTEO name and logo. Nothing on this website transfers any of that to you, and viewing a page gives you no licence beyond clause 2.
Other names, logos and trade marks that appear on this website belong to their owners. Where we name a third-party product, system or organisation, we do so to describe what RTEO works with. It does not imply that the owner endorses RTEO, or that RTEO is endorsed by, an agent of, or affiliated with that owner, unless the page expressly says so.
4. The information on this website
We take reasonable care with what we publish here, and we try to keep it current.
Even so, this website is general information about RTEO and what the platform does. It is not advice, and it is not a commitment. In particular:
- nothing on this website is legal, compliance, privacy, financial or regulatory advice, and nothing here tells you whether you meet your own obligations as a Registered Training Organisation or as an APP entity;
- a description of a platform feature describes it as at the date of publication. Features change, and a description here is not a warranty that a feature exists, works in a particular way, or is included in any particular plan;
- a price, plan or inclusion shown here is indicative unless it is in a quote or an order addressed to you; and
- a case study, statistic or example describes a particular situation. It is not a prediction or a promise about yours.
To the maximum extent the law allows, this website is provided "as is". We do not warrant that it will be available, uninterrupted, error-free, free of harmful code, or that the information on it is complete, accurate or current, and we are not liable for any loss arising from your use of it or your reliance on it.
5. Links to other websites
This website links to websites we do not operate, and other websites link to this one. A link is not an endorsement, and we do not control, check or take responsibility for another website's content, security, privacy practices or availability. Follow a link at your own risk, and read that website's own terms and privacy policy.
You may link to this website's home page or to a public page on it, provided you do so fairly, do not suggest an association, approval or endorsement that does not exist, and do not frame or present our content as part of your own site.
6. Enquiries and anything you send us
Where you send us an enquiry, fill in a form, or book a consultation through this website, we handle your personal information as RTEO's Privacy Policy describes. Cookies and analytics on this website are described in RTEO's Cookie Policy.
Do not send us sensitive information, a Unique Student Identifier, a government identifier, an identity document, or another person's personal information through a general enquiry form. Those forms are not built to hold it.
Where you send us an idea, a suggestion or feedback about RTEO through this website, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without obligation to you and without attribution. Do not send us anything you want to keep confidential.
7. Australian Consumer Law
Nothing in these website terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a statutory guarantee applies and we are permitted to limit our liability for failing to meet it, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.
Subject to that, and to the maximum extent the law allows, we are not liable to you for any loss of profit, loss of revenue, loss of data, loss of goodwill or any indirect or consequential loss arising from your use of this website.
8. Changes, and availability
We may change this website, its content and these website terms at any time. Each version of these website terms carries a version number and an effective date at the top of this document. The version published at this address is the current version, and it is in force from its effective date. Your continued use of this website after a change is acceptance of the changed website terms.
We may change, suspend or withdraw this website or any part of it without notice, and we do not undertake to keep it available.
9. Governing law
These website terms are governed by the laws of New South Wales, Australia, and any dispute under them is subject to the non-exclusive jurisdiction of the courts of New South Wales.
